The inefficiencies of American litigation is disturbing to trial lawyers, too. Jury verdicts are down–but it’s still not enough. In business disputes, and especially business-to-business ones, we’d like to see fewer filings, and faster ADR resolutions (even at the risk of less “fair and less “thorough” outcomes on the merits).
